Bios - "cannot run under a protected environment"

ran into this problem tonight
because i was booting off a compact flash 512mb with DOS 7.1 installed

the problem was solved by formatting a 720K floppy with system files (format A: /F:720 /S)
and then after the bare command.com boot, the bios update has no problems.
